Received a demand letter?

Did you get a notice from Vivek Shah?

Firms are sending demand letters over website tracking: pixels, chat tools and session replay firing without valid consent. We help you find what is running, fix it fast and document the evidence your counsel needs.

  • A technical review of what your site is actually doing
  • Consent enforced before tags fire
  • Evidence and records your counsel can use

Does your letter look like this?

Most of these demands allege that a Meta Pixel or similar tracking tool shared visitor activity with a third party without valid consent, and claim damages under the California Invasion of Privacy Act.

Captain Compliance is not a law firm and this is not legal advice. We help you and your counsel understand what your site was doing and fix it.

The law behind the claim

Under the California Invasion of Privacy Act (CIPA), Cal. Penal Code § 630 et seq., a person whose communications are illegally tapped, read or learned is entitled to $5,000 per violation (Cal. Penal Code § 637.2).

Courts have held that Cal. Penal Code § 631(a) is not limited to phone lines and also applies to new technologies such as computers, the internet and email. See Matera v. Google, Inc., 2016 WL 8200619 at *21 (N.D. Cal. 2016); Bradley v. Google, Inc., 2006 WL 3798134 at *5-6 (N.D. Cal. 2006).

Under California common law, claims for intrusion upon seclusion and invasion of privacy ask whether (1) there was a reasonable expectation of privacy and (2) the intrusion was highly offensive. In re Facebook, Inc. Internet Tracking Litigation, 956 F.3d 589 (9th Cir. 2020).

Fix the tracking. Document the fix.
