There is a particular moment in the arc of every disruptive technology when it transitions from being a thing that organizations talk about to a thing that is already embedded in their operations, whether they intended it or not. For smartphones in the workplace, that moment came and went before most companies had coherent device policies. For AI transcription tools in meetings, the technology arrived faster than consent frameworks could keep pace. For generative AI in daily workflows, half the workforce had personal accounts before IT departments had finished writing their first acceptable use policies.
Smart glasses are approaching that moment now. And the organizations that are waiting for the technology to feel more normal before addressing it are making a mistake that is becoming familiar — and increasingly costly.
The image that opens this conversation is the right one to sit with: an elementary school teacher wearing recording-capable eyewear in a classroom of children who cannot meaningfully consent to being filmed. If that happened — and apparently it has — it happened not because the teacher was malicious, and probably not because school administration made a considered decision to allow it. It happened because no one had thought about it at all. The device was there. The policy wasn’t.
That gap — between technology in the hands of employees and governance frameworks capable of managing it — is where significant legal, ethical, and reputational exposure lives. The question for privacy and AI governance professionals is not whether to address it. The question is whether they will address it before or after something goes wrong.
What Smart Glasses Actually Are Now — and What They’re Becoming
Part of what makes smart glasses a difficult governance challenge is that the category covers an enormous range of capabilities, and those capabilities are moving quickly. The smart glasses of two years ago were largely novelty devices — interesting as technology demonstrations but limited in practical utility. The smart glasses available today are a materially different proposition.
Current consumer and prosumer models can capture continuous audio and video, take photographs, livestream to external platforms, and in some cases operate with features specifically designed to minimize the visibility of recording activity. The LED indicators that some models include to signal active recording — often cited by manufacturers as privacy-enhancing features — are small, easily overlooked in normal social interaction, and in some cases modifiable by technically sophisticated users. They are not consent mechanisms. They are notice-adjacent gestures, and the distinction matters.
The integration of AI capabilities into these devices is where the governance problem becomes substantially more complex. Smart glasses equipped with AI can do more than record — they can process what they record in real time. Real-time transcription of conversations. Translation between languages. Recognition of text on screens, whiteboards, or documents within the wearer’s field of view. Facial recognition against external databases. Generation of voiceprints from audio. Extraction of structured data from visual input.
Each of these capabilities has a legitimate use case. Each of them also has a privacy exposure profile that is qualitatively different from the device simply recording video. When a smart glasses wearer walks into a meeting, captures a slide deck that includes unreleased financial projections, and that visual information is processed by an AI system running in a cloud environment outside the company’s data infrastructure — the data has left the building before anyone in the room knew it was being collected.
This is the low-friction pathway that makes smart glasses a distinct category of risk from other workplace recording technology. A smartphone camera is visible, requires deliberate action, and is socially recognized as a recording device. Smart glasses, particularly as they become more visually indistinguishable from ordinary prescription eyewear, carry no such social signal. The person across the conference table has no reliable way to know whether they are being recorded, what is being done with that recording, or where the resulting data is being stored.
The Biometric Problem Nobody Has Solved
The most legally serious dimension of smart glasses in the workplace — and the one that most governance frameworks are underequipped to address — is biometric data.
In states with biometric privacy laws, including Illinois under BIPA, Texas, Washington, and a growing list of others, the collection of biometric identifiers requires specific disclosures, written consent, and compliance with defined retention and destruction schedules. Biometric identifiers typically include facial geometry data and voiceprints — exactly the categories of data that AI-equipped smart glasses can generate as a byproduct of ordinary use.
A smart glasses wearer who activates video recording in a meeting does not need to intend to collect biometric data in order to collect it. The AI processing layer does that automatically, as a function of the technology’s normal operation. The resulting facial geometry data and voiceprints for every person in that meeting’s field of view may qualify as biometric identifiers under applicable state law, triggering obligations that the organization almost certainly has not prepared for.
The consent problem here is genuinely intractable with current technology, and governance teams should be honest about that rather than constructing policy frameworks that are theoretically elegant but operationally impossible.
Written biometric consent obtained in advance of a meeting is feasible for employees — include a biometric data release in onboarding documentation, update it as AI capabilities change, and you have partial coverage for your own workforce. This is partial coverage for at least two reasons: it only addresses situations where employees themselves are the subjects, and it only functions as genuine consent if employees understand, when signing onboarding paperwork, what specific technologies and capabilities they are consenting to — a standard that most existing onboarding releases do not meet.
For anyone who is not an employee — clients, vendors, interview candidates, building visitors, delivery personnel, the person who wanders into the background of a hallway conversation — there is no workable mechanism for obtaining written biometric consent before their facial geometry is processed by an AI system integrated with a coworker’s glasses. The litigation emerging around AI transcription tools makes clear that courts and regulators are not going to accept “it’s technically difficult” as a compliance posture. The Illinois Supreme Court’s interpretation of BIPA has been consistently expansive. The per-violation damages exposure under BIPA for unauthorized biometric data collection runs to $1,000 to $5,000 per person per violation.
This is the area where the technology has genuinely outpaced any workable compliance model, and the appropriate governance response is to acknowledge that gap explicitly rather than papering over it with consent language that no reasonable person would describe as meaningful consent.
The Enforcement Gap That Complicates a Simple Ban
Many organizations will instinctively reach for the cleanest available policy instrument: a total ban on smart glasses in the workplace. The appeal is obvious. A complete prohibition eliminates the compliance complexity, signals clear institutional values, and gives managers a simple rule to enforce.
The appeal is also, in large part, illusory — and not because a ban is the wrong principle but because it is increasingly unenforceable in practice.
The central problem is that smart glasses are becoming visually indistinguishable from ordinary prescription eyewear. This is not an accidental byproduct of design choices aimed at other objectives. It is, for some manufacturers, a deliberate feature — discretion is a selling point. As the form factor converges with conventional glasses, a manager attempting to enforce a smart glasses ban will face situations in which they cannot reliably determine whether the glasses an employee is wearing have recording capabilities. Demanding that employees remove their glasses in order to verify they are not recording glasses is not a policy. It is a workplace relations incident waiting to happen, with meaningful legal exposure under disability discrimination frameworks if the employee’s prescription eyewear is confused with recording-capable devices.
The accommodation dimension makes a total ban legally more fragile still. Wearable technology is a legitimate and growing category of assistive technology. Real-time captioning, hearing assistance, memory support for employees with certain cognitive disabilities, and other accessibility applications are genuine use cases for smart glasses that fall squarely within the interactive accommodation process under the ADA and its state equivalents. A categorical ban without a clearly articulated accommodation pathway will not survive legal scrutiny — and more practically, it will not survive the first accommodation request from an employee with a genuine need, which is likely to arrive before the policy has been in place long enough to have become institutionally embedded.
None of this means that total bans are never appropriate. In environments where the population being recorded cannot meaningfully consent and the potential for harm is severe — schools with young children, pediatric healthcare settings, mental health facilities, spaces where domestic violence survivors or other vulnerable populations may be present — the case for categorical prohibition is strong and the accommodation analysis may yield different results. These are contexts where the heightened sensitivity of the environment shifts the balance in ways that justify restrictions that would not be proportionate elsewhere.
But for most workplaces, the stronger governance approach is not prohibition but calibration: strict rules in high-risk contexts, flexibility with appropriate safeguards where the risk profile permits it, and clarity throughout so that neither employees nor managers are improvising at the moment of decision.
What a Policy That Actually Works Looks Like
The core policy architecture for smart glasses governance involves five areas that need to be addressed together rather than in isolation. Addressing any one of them without the others produces a framework with predictable gaps.
Zone designation is the foundation. Some spaces should be unconditionally off-limits for recording — restrooms, lactation rooms, locker rooms, and any space where individuals have a reasonable expectation of privacy that the law and basic dignity both require to be respected. Beyond those absolute prohibitions, organizations need to map their physical environments against their risk profiles. Conference rooms used for sensitive leadership discussions, legal meetings, M&A planning, or HR proceedings involving employee personal information warrant explicit recording restrictions. Areas where proprietary information is regularly displayed — screens visible from open areas, whiteboards with strategic content — need to be assessed. Physical signage in restricted areas is not merely a courtesy. It creates the notice that strengthens enforcement and, in litigation, demonstrates that the organization took its obligations seriously.
Consent and notice architecture needs to be designed for the real world rather than the ideal world. The minimum viable standard — and the one that best manages legal and trust risk across the patchwork of U.S. and international consent requirements — is a single organizational rule that notice be provided and consent obtained before recording, regardless of jurisdiction. Relying on employees to determine in real time whether their current interaction is governed by one-party or all-party consent rules is not a policy. It is a liability transfer that the organization will not benefit from when it goes wrong.
The technology’s own notice features — indicator lights, shutter sounds — should be understood for what they are: aids to transparency, not consent mechanisms. A policy that treats an illuminated LED as the equivalent of informed consent will not survive a conversation with a plaintiff’s attorney, let alone a jury.
Data lifecycle governance is where smart glasses policy most frequently fails to integrate with existing information security frameworks. The exposure created by smart glasses is not confined to the moment of capture. It extends to everything that happens to recorded data afterward: where it is stored, under what access controls, for how long, with what sharing restrictions, and under what deletion schedules. An employee who records a meeting and stores the file in a personal cloud account has created a data governance incident that sits entirely outside the company’s information security perimeter. A policy that addresses recording but not retention, access, sharing, and deletion is addressing the visible part of the problem while the significant legal exposure accumulates downstream.
Objection management requires explicit procedural architecture rather than managerial discretion. The scenarios that will actually test a smart glasses policy are predictable in their categories: an employee objects to being recorded by their manager during a performance review; a client objects to being recorded during a sales meeting; an employee wants to record a meeting for accessibility purposes and the company wants to object; a meeting involves confidential information and a participant’s recording device is discovered mid-session. Each of these scenarios needs a defined response pathway — not a principle that managers are expected to apply by instinct under social pressure.
The escalation path is particularly important. When a recording objection cannot be resolved in the moment, managers should not be making binding decisions unilaterally. They need a named contact — in HR, legal, or a compliance function — who is empowered to make a call and whose decision represents the organization’s position. Policies that leave this undefined will produce inconsistent enforcement, and inconsistent enforcement produces discrimination claims.
Accommodation processes need genuine cross-functional design rather than a handoff from HR to IT after the fact. When an employee requests smart glasses as an accommodation, the interactive process has to engage privacy, security, and AI governance alongside HR, because the accommodation decision has technical implications for data handling that HR alone cannot assess or implement. What can the accommodated recording capture? Where does it go? Who can access it? How long is it retained? Is it processed by AI? Does that processing create biometric data subject to separate obligations? These questions have answers, and those answers need to be built into the accommodation approval and implementation, not discovered when something goes wrong.
The Litigation Horizon
Privacy professionals who track litigation trends will recognize that the smart glasses case is already being developed in adjacent contexts, and the legal theories being established there will transfer directly.
The pending class actions against AI transcription tool providers establish the template. One complaint alleges that an AI transcription tool, once connected to a host’s calendar, automatically joined meetings and began recording and generating data without providing notice to or obtaining consent from other participants. A second alleges that a participant’s voice was captured, a voiceprint generated, and the individual’s biometric data collected — all without notice, written disclosure of purpose or collection duration, or written release.
These cases involve virtual meeting tools rather than physical smart glasses, but the legal theories are identical. Unauthorized recording. Unauthorized biometric data collection. Failure to provide notice. Absence of written consent. The same claims attach to a smart glasses wearer who activates recording in a physical meeting room. The fact that the device is worn rather than connected through a calendar integration changes the form of the harm, not its legal character.
The addition of physical recording capability — the ability to capture real-world environments, not just virtual meeting participants — expands the risk. A virtual meeting tool captures only those who chose to participate in the meeting. A smart glasses wearer in a building lobby, a cafeteria, or an open office captures everyone in their field of view, including people who have no idea they are being recorded and no mechanism for objecting.
BIPA litigation in Illinois has consistently exceeded defense expectations in scope and scale. The Supreme Court of Illinois has interpreted the statute expansively, and per-violation damages have produced settlement demands in the hundreds of millions against companies whose violations were far less systematic than what smart glasses deployed at scale would produce. Organizations that wait for the first employee with recording-capable eyewear to trigger a biometric data incident before developing a response will find that the litigation environment has not been waiting for them.
The Normalization Risk
There is a dynamic in technology adoption that governance professionals need to factor into their timeline for action, and it is one that typically gets underweighted because it operates slowly and then suddenly.
Technologies that feel intrusive when they are new have a consistent tendency to stop feeling intrusive as they become common. The discomfort that most people would currently feel at discovering they had been unknowingly recorded by a colleague’s glasses is real, and it reflects genuine intuitions about privacy, consent, and the appropriate boundaries of surveillance in professional relationships. That discomfort is a resource — it creates social pressure for responsible adoption and gives governance frameworks a cultural foundation to build on.
That resource depletes as the technology normalizes. When smart glasses are as common a workplace sight as AirPods, the same conduct that would today trigger a significant workplace relations incident may generate no reaction at all. The behavioral baseline will have shifted, and the ethical concerns will not have been resolved — they will simply have been normalized out of visibility.
Governance teams that wait until smart glasses feel normal to develop policy will find that the technology is already embedded in workflows, the data practices around it have calcified into organizational habits, and the cultural foundation for meaningful guardrails has eroded. Rolling back embedded technology is dramatically harder than setting expectations before adoption becomes widespread. The teacher wearing recording glasses in the kindergarten classroom is not a distant future risk. It is a current reality, and the policy that should have preceded it does not exist.
The Honest Reckoning
Smart glasses policy sits at the intersection of several of the most difficult ongoing problems in workplace privacy governance: biometric data collection for which no workable consent model exists; recording capabilities that outpace the jurisdictional patchwork of consent law; AI processing that creates regulated data categories as a byproduct of features the user activated for an entirely different purpose; disability accommodation obligations that complicate categorical restrictions; and a technology form factor that is actively converging with ordinary eyewear in ways that defeat visual identification.
None of these problems has a clean solution. The honest governance posture — which is ultimately more defensible than false confidence — acknowledges that the compliance model for smart glasses is incomplete, that some obligations are difficult to satisfy in practice, that enforcement of any policy will be imperfect, and that the frameworks developed today will need to evolve as the technology changes.
What that honest posture does not permit is inaction. The choice is not between a perfect policy and no policy. It is between an imperfect policy that reflects genuine institutional effort and demonstrates good-faith compliance posture, and no policy at all — which, in litigation or regulatory proceedings, looks exactly like what it is: an organization that knew the risk was there and chose not to address it.
The smart glasses may already be in your building. The question is whether the policy is, too — and whether it is the kind of policy that would survive scrutiny from a regulator, a plaintiff’s attorney, or an employee who discovers they were recorded without their knowledge in a space where they had every right to expect privacy.
