Brazil’s ECA Digital Is Live. The Era of Polite Warnings for Big Tech Is Over

For years, the global conversation about protecting children online has been long on urgency and short on teeth. Governments have issued guidelines. Platforms have published community standards. Regulators have sent letters. Children have continued to be exposed to harmful content, predatory behavior, and algorithmic systems designed to maximize engagement at any cost to their wellbeing.

Brazil just changed the terms of that conversation.

As of this week, Brazil’s Lei nº 15.100 — known as ECA Digital, an amendment to the country’s landmark Child and Adolescent Statute — is formally in effect. Six months after its passage through Congress, the law is no longer a future obligation. It is a present one. And for any platform operating in Brazil’s market of over 215 million people, the compliance clock is no longer counting down. It has expired.

What ECA Digital Actually Does

The law’s name tells you something important about its intent. The ECA — Estatuto da Criança e do Adolescente — has been Brazil’s foundational framework for child protection since 1990. It governs physical safety, welfare, education, and rights. ECA Digital extends that framework explicitly into the online environment, treating digital platforms not as neutral infrastructure but as environments with affirmative obligations to the children who use them.

The core thrust of the law is straightforward: platforms must implement meaningful protections for children and adolescents, or face consequences severe enough to force behavioral change. This is not a notice-and-comment regime. It is not a self-regulatory framework. It is binding law with a real enforcement ladder.

That ladder looks like this. Platforms that violate the law face warnings at the first level. Violations that persist or are more serious trigger fines of up to the equivalent of roughly $10 million per infraction. In extreme cases — where a platform is deemed to pose an ongoing risk to children and refuses to come into compliance — Brazilian courts have the authority to impose suspensions or outright bans from operating in the country entirely.

That last provision is not rhetorical. Brazil has used platform bans before. When X, formerly Twitter, failed to comply with court orders in 2024, Brazilian authorities suspended the platform’s operations in the country for over a month. The appetite to use enforcement authority exists. ECA Digital gives regulators and courts a cleaner legal basis to use it specifically in the context of child protection.

Why This Law Is Different From What Came Before

The history of child online safety legislation internationally is littered with laws that were well-intentioned and poorly enforced. The reasons vary — inadequate regulatory capacity, jurisdictional complexity, platform lobbying, or simply fines too small to register on the balance sheets of companies generating tens of billions in annual revenue.

ECA Digital is designed with some of those failures in mind.

The $10 million fine ceiling is meaningful at the individual platform level, but the more significant deterrent is the suspension and ban mechanism. For a platform whose business model depends on scale and network effects, losing access to Brazil — one of the world’s most active social media markets — is an existential threat to growth projections, not a manageable line item. This is the enforcement logic that regulators in the EU applied when designing GDPR and the Digital Services Act: make the consequence proportionate to the stakes, not just the violation.

The law also reflects a substantive shift in how Brazil is thinking about platform responsibility. ECA Digital does not simply require platforms to remove harmful content after it appears. It imposes affirmative obligations — platforms must build and maintain systems that protect children, not merely react when protection fails. This is the difference between a reactive content moderation regime and a proactive safety-by-design obligation. It is a meaningful legal distinction, and it reshapes what compliance actually requires.

The Global Pattern Brazil Is Joining

Brazil’s move does not happen in a vacuum. ECA Digital is the latest in a wave of child online safety legislation that has swept through major jurisdictions over the past two years, and understanding it in that context matters for any organization managing global compliance.

The United Kingdom’s Online Safety Act, which received Royal Assent in 2023, imposes similarly stringent obligations on platforms with child users, including duties of care, age verification requirements, and algorithmic transparency obligations. Australia passed its own Online Safety Act and has been pushing platforms hard on age-appropriate design standards. In the United States, the Children’s Online Privacy Protection Act is undergoing its most significant revision in decades, and several states — including California with its Age-Appropriate Design Code — have moved ahead of federal action with their own frameworks.

The pattern is consistent across every jurisdiction: governments are moving from voluntary frameworks to mandatory ones, from reactive enforcement to proactive obligations, and from fines too small to matter to penalties calibrated to actually change platform behavior.

Brazil is not an outlier. It is part of a coordinated global shift in how democratic governments are choosing to regulate the relationship between commercial platforms and the children who use them. For compliance teams at global platforms, the question is no longer whether this regulatory environment is coming. It is already here.

What ECA Digital Requires in Practice

The specific operational obligations under ECA Digital are worth understanding carefully, because they are more demanding than a simple content moderation requirement.

Age-appropriate design. Platforms must configure their services to provide enhanced protections for users identified as children or adolescents. This goes beyond age-gating — it includes algorithmic recommendations, notification patterns, and feature availability. Systems designed to maximize engagement for adult users are not, by default, appropriate for minors, and the law treats that distinction as an affirmative compliance obligation.

Prohibition on harmful content promotion. Platforms cannot algorithmically amplify content that poses risks to the psychological, physical, or developmental wellbeing of children. This is a direct challenge to recommendation systems that optimize for engagement without regard to the age or vulnerability of the viewer.

Data protection for minors. ECA Digital operates alongside Brazil’s Lei Geral de Proteção de Dados — LGPD — and strengthens protections for personal data collected from children and adolescents. Consent requirements are more stringent, data minimization expectations are higher, and the commercial use of children’s data faces meaningful restrictions.

Parental controls and transparency. Platforms must provide parents and guardians with meaningful tools to understand and manage how their children interact with the platform. This is not a vague obligation — it requires functional, accessible, and genuinely useful parental oversight mechanisms.

Reporting and accountability mechanisms. Platforms must maintain accessible reporting channels for violations and demonstrate operational capacity to respond to complaints involving child safety within defined timeframes.

The Compliance Reality for Global Platforms

For organizations already operating robust child safety programs in compliance with UK, EU, or Australian requirements, ECA Digital will require gap analysis rather than ground-up program construction. The principles are largely aligned — age-appropriate design, proactive harm prevention, data minimization, meaningful parental controls — and organizations that have genuinely implemented those principles rather than box-checking them will find Brazil’s framework navigable.

For organizations that have treated child safety compliance as a checkbox exercise — minimum viable compliance in each jurisdiction, calibrated to the lowest enforcement risk — ECA Digital is a harder problem. Brazil’s enforcement posture, demonstrated clearly in the X case, suggests that the government is prepared to use its full authority when platforms do not take their obligations seriously.

The distinction that matters is between organizations that have built child safety into their product and operational architecture, and those that have layered compliance documentation on top of systems not designed with child safety in mind. The first group can adapt to new jurisdictional requirements through configuration and gap remediation. The second group faces a more fundamental challenge that no compliance program can fully paper over.

What Your Team Should Be Doing Now

If your organization operates in Brazil or is considering expansion into the Brazilian market, the following questions are worth answering before the first enforcement action lands.

Does your platform have a documented and implemented age verification or age estimation mechanism? Not a terms of service age confirmation — an actual technical or procedural mechanism.

Are your algorithmic recommendation systems configurable to apply different parameters for identified minors? If not, how are you demonstrating that your recommendations are appropriate for child users?

Have you conducted a data protection assessment of your data collection and processing practices as they apply to users under 18 in Brazil, specifically in light of LGPD and ECA Digital together?

Do you have parental control functionality that is accessible, functional, and meaningfully communicated to users?

Is there a designated point of contact or team responsible for ECA Digital compliance, and do they have the authority and resources to actually implement required changes?

If any of these questions produces a hesitant answer, the time to address it is now — not when a regulator is asking the same questions under different circumstances.

Brazil’s ECA Digital is a signal as much as it is a law. It signals that major emerging market democracies are no longer willing to accept the argument that platform self-regulation is an adequate substitute for legal obligation when children are involved. It signals that enforcement mechanisms are being designed with the specific intent of being consequential enough to change behavior. And it signals that the jurisdictional patchwork of child online safety regulation is going to continue expanding, in scope and in seriousness, for the foreseeable future.
