Colorado has been trying to get this right for a while. After a high-profile legislative near-miss in 2024 — when Governor Jared Polis signed SB 205 into law and then almost immediately called for its revision — the state’s AI Policy Workgroup has come back with a framework that signals something important: Colorado isn’t retreating from AI regulation. It’s refining it.
The revised framework, recently advanced by the Colorado AI Policy Workgroup, represents more than a technical amendment. It reflects a growing consensus among state regulators that the first wave of AI legislation moved too fast on definitions and too slow on operationalization. What Colorado is now proposing is more grounded, more implementation-focused, and frankly, more useful for the organizations that have to actually comply with it.

Why Colorado’s AI Law Was Stalling
To understand the revision, you have to understand why the original framework ran into trouble.
Colorado’s SB 205, passed in May 2024, was the first comprehensive state AI law in the United States. It imposed obligations on both developers and deployers of “high-risk” AI systems — systems used to make or substantially assist consequential decisions about consumers in areas like employment, housing, credit, education, and healthcare. The ambition was right. The execution had problems.
Critics — including many in the business and legal communities — pointed to definitions that were difficult to operationalize, requirements that were unclear in their application to third-party AI tools, and compliance timelines that didn’t account for the practical realities of enterprise AI governance. The Governor himself acknowledged the law needed work before its February 2026 effective date.

A clearer definition of what triggers obligations. One of the original law’s biggest practical problems was ambiguity around what constituted a “consequential decision” and when a developer versus a deployer bore primary responsibility. The revised framework tightens these definitions and creates clearer delineation between the obligations of those who build AI systems and those who deploy them in consumer-facing contexts. A refined approach to automated decision-making. The revised framework explicitly addresses automated decision-making technologies (ADMT) as a distinct category, not just a subset of AI generally. This is significant. ADMT — systems that make or substantially contribute to decisions without meaningful human review — carries a different risk profile than AI tools used for analysis or content generation. Treating them separately in the law creates cleaner compliance pathways.
Greater emphasis on consumer-facing transparency. The Workgroup’s framework strengthens requirements around disclosure to consumers when AI or ADMT is used in decisions that affect them. Consumers would have the right to know that an automated system was involved, to understand the basis for an adverse decision, and in certain cases, to request human review. For organizations already managing GDPR or CCPA obligations, this structure will look familiar — and that’s intentional.
A recalibrated approach to developer obligations. Under the original law, the obligations placed on AI developers — the companies building the underlying models and systems — were broad enough to create significant uncertainty about liability across complex AI supply chains. The revised framework attempts to align developer obligations more directly with what developers can actually control, and deployer obligations with what deployers can actually govern. This is a more defensible and more practical structure.
Why This Revision Is a Signal, Not Just a Story
Colorado’s willingness to revise its own landmark AI law before it even takes effect is unusual. Legislatures rarely admit a law needs work this quickly. The fact that Colorado convened a serious Workgroup, engaged stakeholders, and produced a substantive revised framework tells us something important about the direction of state AI regulation nationally.
This is not a retreat. It is a recalibration — and there is a meaningful difference between the two.
Other states watching Colorado’s stumble with SB 205 may have quietly concluded that comprehensive AI legislation was too complex to operationalize. The revised framework pushes back on that conclusion. Colorado is effectively saying: the answer to hard implementation problems is not to abandon the policy goal. It is to build better policy.
For organizations operating in multiple states, this matters beyond Colorado. The frameworks being developed right now — in Colorado, in Texas, in states considering their own AI legislation — are laying the groundwork for what national AI regulation, if it ever arrives, will likely look like. Building compliance capacity now, even in states where the law is still evolving, is not premature. It is strategic.

The revised framework attempts to anchor the definition more firmly in specific domains — employment, housing, credit, education, healthcare, insurance — and to clarify what level of AI involvement crosses the threshold from incidental use to decision-making that triggers obligations.
This domain-based approach mirrors how federal anti-discrimination law has long worked. The Fair Housing Act, the Equal Credit Opportunity Act, Title VII — each applies to specific domains of consequential decisions about individuals. Colorado’s revised framework is, in many ways, extending that logic into the AI context. For compliance teams already operating within those federal frameworks, the revised Colorado structure should feel navigable.
AI Governance for Colorado
If your organization develops or deploys AI systems that touch consumers in Colorado — or anywhere, given how these frameworks tend to propagate — there are several things worth doing right now.
Map your AI and ADMT use to consequential decision domains. The revised framework’s domain-based structure means you need to know which of your AI-assisted processes touch employment, credit, housing, healthcare, education, or insurance decisions. That inventory is the foundation of everything else.
Clarify your role in the AI supply chain. Are you a developer, a deployer, or both? Under the revised framework, your obligations depend significantly on that answer. Many organizations are both — they build some tools and license others — and need compliance programs that address both postures.
Assess your disclosure and transparency posture. The consumer-facing transparency requirements in the revised framework are substantive. If your organization uses AI or ADMT in decisions that affect consumers, you need to evaluate whether your current disclosures — in privacy notices, adverse action communications, and customer-facing interfaces — meet the standard the framework is moving toward.
Don’t wait for the final law. Colorado’s revised framework is not yet law. It will go through a legislative process, and the final text may differ from current proposals. But the direction is clear, and organizations that begin building compliance infrastructure now — based on what the framework signals — will be far better positioned than those who wait for the final version before starting.
