The rapid integration of Artificial Intelligence into the healthcare sector has created a gold rush of convenience. From diagnosing complex conditions to summarizing sprawling medical histories, LLMs (Large Language Models) are demonstrating what researchers call “superhuman” proficiency. However, a significant legal chasm is opening beneath the feet of unsuspecting patients and providers alike.
The core of the issue is a dangerous misunderstanding of regulatory coverage. While your physical doctor is bound by the rigorous mandates of the Health Insurance Portability and Accountability Act (HIPAA), the AI application on your smartphone likely is not. For compliance professionals, this represents one of the most significant data exposure risks of the decade.
The Myth of “HIPAA-Ready”
Tech giants like OpenAI, Anthropic, and Google have all launched healthcare-focused initiatives over the past year. Their marketing materials are often peppered with reassuring phrases. Anthropic describes its infrastructure as “HIPAA-ready,” while OpenAI claims its enterprise products “support” HIPAA compliance.
To the average user, these sound like guarantees. To a compliance officer, they are “pinky promises” rather than legal mandates.
“Organizations that are building apps, there’s a real gray area for any sort of compliance” with healthcare data privacy laws, notes Carter Groome, CEO of First Health Advisory. Groome warns that tech companies are often “hyperbolic” in their security commitments to assuage privacy critics. “It’s really shaky right now when a company comes out and says ‘we’re fully HIPAA compliant’ and I think what they’re doing is trying to give the consumer a false sense of trust.”
The Regulatory Gap: Covered Entities vs. Tech Platforms
The legal reality is that HIPAA was designed for a pre-AI world. It applies to “covered entities”—health plans, clearinghouses, and healthcare providers—and their direct business associates who handle Electronic Protected Health Information (ePHI).
As Andrew Crawford, senior counsel at the Center for Democracy and Technology’s Data and Privacy Project, points out: “A number of companies not bound by HIPAA’s privacy protections will be collecting, sharing, and using peoples’ health data. Since it’s up to each company to set the rules for how health data is collected, used, shared, and stored, inadequate data protections and policies can put sensitive health information in real danger.”
Because these tech platforms are often not considered covered entities, the data you share with them falls into a different legal bucket: consumer information.
“On a federal level there are no limitations—generally, comprehensively—on non-HIPAA protected information or consumer information being sold to third parties, to data brokers,” says Sara Geoghegan, senior counsel at the Electronic Privacy Information Center. Geoghegan highlights that while HIPAA helps with the digitization of records, it wasn’t built to “stop tech companies from gathering your health data outside of the doctor’s office.”
The 23andMe Warning Shot
We have already seen the consequences of sensitive health data living outside the HIPAA umbrella. Geoghegan points to the bankruptcy and subsequent sale of the genetic testing firm 23andMe as a prime example. When a company holding sensitive biometric or medical data fails or is acquired, that data becomes an asset to be sold. Without the rigid protections of HIPAA, there is very little to prevent that information from ending up in the hands of data brokers or insurers who may use it for risk modeling.
AI health apps carry these same structural risks, compounded by the inherent vulnerabilities of generative AI:

Despite these risks, the sheer cost and inaccessibility of traditional American healthcare are driving millions of people toward AI alternatives. They are convenient, immediate, and often free. But as Geoghegan notes, “the solution to that care being inaccessible cannot be relying on big tech and billionaire’s products. We just can’t trust them to have our best health interest in mind.”
