AI Voice Calls and the Consent Gap That’s Sending Companies to Court

You did everything right on the TCPA side. Your opt-in form has clean consent language. Your scripting covers the FCC’s prerecorded call disclosure requirements. You confirmed prior express written consent before sending a single marketing call through your AI voice platform. By most measures, you’re ahead of the game.

So why are businesses with solid TCPA compliance still finding themselves exposed to significant litigation risk the moment their AI voice system picks up?

Because there’s a second consent requirement most of them never thought about — and it has nothing to do with marketing law.

The Piece That Gets Left Out

Here’s what’s getting missed: two-party consent to record the call.

Dozens of states — including California, Illinois, Florida, and Pennsylvania — require all parties to consent before a phone conversation can be recorded. If your AI voice system is logging calls, transcribing audio, or feeding conversations back into a training dataset, those calls are being recorded. And if the consumer on the other end of that call wasn’t clearly informed and didn’t consent to the recording, you have a problem that your TCPA disclosure cannot fix.

This isn’t a technicality. The TCPA form consent and the recording consent are legally distinct obligations. One addresses whether you had permission to place an automated or AI-assisted call. The other addresses whether you had permission to capture and use the audio that resulted from it. Your opt-in form can be bulletproof on the first question and completely silent on the second.

What the Courts Are Already Saying about CIPA

California’s Invasion of Privacy Act — CIPA — has become the primary vehicle for these claims, and the case law is developing fast.

In Taylor v. ConverseNow, plaintiff Eliza Taylor alleged that when she called Domino’s to place a pizza order, her call was routed to ConverseNow’s AI virtual assistant without any notice to that effect. She claimed the AI system recorded her name, address, and credit card information in a manner that served ConverseNow’s own product development and training purposes.

ConverseNow argued that as a service provider for Domino’s, it was functionally an extension of the restaurant — not a third party intercepting communications. The court rejected that argument and denied the motion to dismiss.

The legal theory that carried the day was the “capability test.” Under that framework, the relevant question is not whether the AI vendor actually used the call data for its own purposes. The question is whether it had the capability to do so. Because ConverseNow could use the recorded content to train or improve its own platform, that capability alone was enough to establish a potential CIPA violation — regardless of whether the company acted on it.

The implication is significant: if your AI voice platform has any contractual right to access call content for model training, quality improvement, or any other internal use, you may already have a capability test problem embedded in your vendor agreement. That exposure doesn’t disappear because the vendor hasn’t exercised the right yet.

Three Steps to Close the Gap

1. Audit your disclosures — both of them. Your TCPA consent language addresses the call itself. Your call recording disclosure needs to address the capture of audio. Review both independently. If your scripting only covers the prerecorded call requirements and goes silent on recording consent, that’s the gap. Fix the script before your next campaign runs.

2. Require affirmative consent, not passive continuation. Several states treat “staying on the line” as implied consent to recording — but that standard doesn’t hold everywhere, and area codes are an unreliable indicator of which state’s law applies to any given caller. The safer approach is treating every consumer as if they’re in a two-party consent jurisdiction and capturing explicit acknowledgment before the substantive conversation begins.

3. Build a hard technical gate before any processing starts. If your system is transcribing or analyzing audio during the disclosure itself — before consent has been logged — that’s interception before consent. It doesn’t matter that the disclosure is happening in real time. The architecture needs to enforce a clean separation: no transcription, no analysis, no training data capture until the consent event is recorded. If your current call flow doesn’t do that, the disclosure language on its own won’t protect you.

The Vendor Agreement Problem

Beyond your own call flow, audit what your cloud AI provider is contractually permitted to do with the audio passing through its platform. If your agreement grants the provider rights to access call content for any purpose — model improvement, quality assurance, internal research — that language creates the exact capability test exposure the Taylor v. ConverseNow court identified. Negotiate those provisions out, or if they can’t be removed, disclose the arrangement to consumers explicitly before the call proceeds.

What This Means for Your Compliance Stack

TCPA compliance and call recording compliance operate on parallel tracks that need to be managed together. The consent you’ve already captured for AI voice calls is necessary. It’s just not sufficient.

Before your next outbound campaign goes live, confirm that your scripting gets recording consent, your architecture enforces a pre-processing gate, and your vendor contracts don’t hand a third party the capability your disclosures don’t cover. If any one of those pieces is missing, the strength of your TCPA language won’t matter when the CIPA claim arrives.
